1. About the Platform
Vacax provides a software and operational management platform that assists property owners in managing accommodation operations, listings, pricing, guest communication, and related processes.
Vacax is not a property owner, hotel operator, travel agency, or accommodation provider.
Vacax provides technological and operational facilitation services only.
Any accommodation agreement is formed directly between the property owner and the guest.
2. Eligibility
By using the Platform, you confirm that:
You are at least 18 years old
You have the legal authority to enter agreements
Information you provide is accurate and complete
You will comply with applicable laws and regulations
3. User Accounts
To access certain features, you may need to create an account.
You agree to:
Keep login credentials confidential
Be responsible for all activities under your account
Immediately notify us of unauthorized access
Provide accurate information
Vacax may suspend or terminate accounts that contain false or misleading information.
4. Platform Services
The Platform may include:
Listing management
Operational automation tools
Messaging tools
Performance analytics
Channel integrations
Operational coordination features
Vacax does not guarantee:
Occupancy rates
Rental income
Guest behavior
Booking volume
Profitability
5. User Responsibilities
Users agree not to:
Violate any law or regulation
Upload false or misleading property information
Interfere with the Platform’s operation
Attempt unauthorized access
Use the Platform for fraudulent purposes
Circumvent platform fees or systems
Property owners remain solely responsible for:
Legal compliance of their listings
Licenses and permits
Taxes
Guest agreements
Property condition and safety
6. Fees and Payments
Fees for services may apply according to separate agreements or service plans.
Vacax reserves the right to:
Modify pricing with notice
Suspend services for unpaid fees
Restrict features until payment obligations are fulfilled
Third-party payment processors may handle transactions.
7. Intellectual Property
All Platform content including:
Software
Algorithms
Designs
Logos
Text
Interface elements
are owned by Vacax or licensed to Vacax.
You may not:
Copy
Reverse engineer
Redistribute
Resell
Commercially exploit
any part of the Platform without written permission.
8. Third-Party Services
The Platform may integrate with third-party providers (booking channels, payment systems, messaging services).
Vacax is not responsible for:
Third-party downtime
External platform policies
External service errors
External data accuracy
9. Availability
We aim to keep the Platform operational but do not guarantee uninterrupted availability.
Vacax is not liable for:
Downtime
Maintenance interruptions
Internet failures
Force majeure events
External service outages
10. Limitation of Liability
To the maximum extent permitted by law:
Vacax shall not be liable for:
Loss of profits
Loss of bookings
Loss of data
Property damage
Guest actions
Indirect or consequential damages
Total liability shall not exceed the amount paid by the user to Vacax in the previous 3 months.
11. Indemnification
You agree to indemnify and hold Vacax harmless from any claims arising from:
Your listings
Your property
Your legal violations
Your agreements with guests
Misuse of the Platform
12. Termination
Vacax may suspend or terminate access at any time if:
Terms are violated
Legal risk exists
Fraud is suspected
Payments are overdue
Users may stop using the Platform at any time.
Termination does not remove outstanding obligations.
13. Privacy
Use of the Platform is also governed by our Privacy Policy available on the website.
14. Modifications
We may update these Terms at any time.
Continued use of the Platform after updates constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the Republic of Türkiye.
All disputes shall be subject to the jurisdiction of Istanbul Courts and Enforcement Offices.
